Welcome to PayLessApartments.com® , Pay Less Apartments, LLC, a Florida Limited Liability Company, and all affiliates, licensors, suppliers and all dba entities including all other registered .coms, .net, .us, .info entities, collectively PayLessApartments.com®.  The following Terms of Use applies to PayLessApartments.com® in connection with its websites, networks, mobile applications, and other services, including all information and content available therein (collectively Services) provided by PayLessApartments.com® . In consideration of PayLessApartments.com® offering its Services, and you using such Services, you hereby agree to be bound by all the provisions of these Terms of Use. You further represent and warrant that you are not a competitor of PayLessApartments.com® or any of its affiliates. If you do not agree to these Terms of Use, you are prohibited from accessing the Services and must immediately discontinue such access.  By accessing the Services, You consent to the collection and use of certain information, as specified in the Privacy Statement.  Any individual who visits, views, accesses or uses any version of the Services, including through a bot or other automated means, hereinafter referred to as you, shall be bound by these Terms of Use.

  1. Our Role At PayLessApartments.com® : PayLessApartments.com® does not, and the Services are not intended to provide Real Estate, Location security or relocation advice.  PayLessApartments.com® is not a real estate broker, agent or advisor.  PayLessApartments.com® is an information and advertising service providing forums, including but not limited to the Services for individuals and business entities, including property managers, and landlords, (Landlords), who have residential apartments for rent offering move in discounts.  Our mission is to connect Landlords to individuals who are looking for an apartment to rent, (Renters) by making available pertinent information about the apartments available for rent, the particulars of the move in discount, and other pertinent information and allowing the Renter to contact the Landlord.  To accomplish this, PayLessApartments.com® solicits landlords who offer move-in discounts and displays the information provided by the Landlord on multiple websites made accessible to Renters. PayLessApartments.com® does not participate in negotiations between the Landlord and Renter, does not represent the Landlord or the Renter, does not rent, offer to rent, is not a party to any transaction between the Landlord and Renter, nor does it otherwise aid or assist in the rental of real property.  PayLessApartments.com® does not guarantee, ensure, or insure any apartment or any transaction between a Renter and Landlord, collect or process payment or execute any lease or sublease documentation on behalf of renters or landlords, or broker, lease, or sublease or offer to broker, lease or sublease, or own any apartments. You are strongly encouraged to personally inspect any apartment advertised for rent prior to signing any lease documentation, providing personal information such as a social security number on a lease application, or sending money for any deposit, rent payment or application fee. By using the Services, you acknowledge that published rents and availabilities are subject to change at the sole discretion of the Landlord at any time and without notice, that the availability of apartments offering a move in discount may be limited in number, and all apartments are available on a first-come, first-served basis.  PayLessApartments.com® reserves the right to change its fees, offer different fees to the same users for similar listings, and otherwise not maintain and apply a uniform fee structure and charges for what it determines in its sole discretion are legitimate business purposes or reasons.

    PayLessApartments.com® assumes no responsibility for any result or consequence related directly or indirectly to any action or inaction that a Landlord or Renter takes or suffers, including but not limited to charges of discrimination, security or lack thereof, or condition of the apartment, as a result of utilizing the Services or any other information available through or in connection with the Services.

  2. Eligibility, Creation of Accounts and Registration:  By using the Services, you represent and warrant that you are at least eighteen (18) years of age, you have not previously been suspended or removed from the Services, and your registration and use of the Services is not in violation of any applicable law or regulation.  To access some features of the Services, you may be required to register for an account.  When you register for an account or accounts, you may be required to provide PayLessApartments.com® with some information about you, such as email address or other contact information.  You agree that the information you provide is accurate and that you shall keep such information current and up to date at all times.  When you register, you may be asked to provide a password.  You are solely responsible for maintaining the confidentiality of your account and password and you are responsible for all actions taken with, on or about your account.  You may not share your account with others, including competitors of PayLessApartments.com® .   Existing renters are not eligible to receive any of the discounts listed on PayLessApartments.com® on a renewal of their existing leased premises if their existing leased premises are listed on PayLessApartments.com®.
  3. Discounts:  We list apartments for rent on our website based exclusively on information provided to PayLessApartments.com® by Landlords.  We endeavor to verify the accuracy of all such listings however due to the quantity of listings we do not warrant the accuracy of such information.  Accordingly, the Renter assumes all responsibility for verifying any information pertaining to an apartment published on our website, including but not limited to availability, price, move-in discounts, application and administrative fee waivers and discounts, amenities, location, etc.  Discounts on application and administrative fees or similar charges are credited upon the Renter’s qualifying as a lessee and renting the property for which they are applying to rent.  Each Landlord will have different criteria, in full compliance with all Federal and local housing discrimination laws, to determine if a renter qualifies to rent the Landlord’s property.  The most common criteria is a minimum credit score, minimum verifiable income, a criminal background check, history of evictions or late rental payments.  A Landlord may have additional criteria or may not have all of the criteria enumerated.  PayLessApartments.com® strongly urges you to inquire about the Landlord’s criteria for qualification BEFORE you pay any fees to apply to rent a property.  If you do not qualify for an apartment you will not receive the discount/reimbursement of your application, administration or other fee for which a discount is published on our website. 
  4. Use of Services And Restrictions:  All Services are protected by copyright and other intellectual property laws. The Services are owned by PayLessApartments.com® . The Services are intended for personal and noncommercial use only. Upon compliance with these Terms of Use, PayLessApartments.com® grants you a non-exclusive, limited, revocable, personal, non-transferable, license to use the Services, and to download and use the mobile app on your mobile device in object code form for your personal use.  You may only use the Services for transactions on your own behalf, and not on behalf on any other person or entity. You may not copy, reproduce, sell, license, publish, distribute, modify, display, perform, combine, create a derivative work from, re-post or otherwise use any portion of the Services in any other way or for any other purpose without the prior written consent of PayLessApartments.com® .  If you are a real estate sale professional acting in your professional capacity you may provide information, to the extent lawful, to your clients and take actions on behalf of your clients.  If you use the Services in this capacity, you represent and warrant that you have obtained all required authorizations and consents from your client.  If you are acting in a professional capacity as defined above, this limited permission does not provide you a license to use, reproduce, distribute, display or provide access to any portion of the Services on third-party websites or otherwise.  Requests regarding use of the Services for any purpose other than personal noncommercial use, or those acting in a professional capacity as set forth above should be directed to support@www.paylessapartments.com attn.: General Counsel, 6801 Lake Worth Road, Suite 315 Greenacres, FL 33409. 
  5. Third-Party Sites: During your use of the Services, you may be taken to third-party websites to fulfill certain site features and functionality. You agree that when visiting third-party websites you are subject to the privacy policy and terms of service, if any, of that third-party website, which may differ from those of PayLessApartments.com® . By selecting links to such third-party websites, you agree that you will be leaving the Services and that PayLessApartments.com® has no responsibility or liability whatsoever in connection with your use or your exchange of any information with such third party websites. PayLessApartments.com® does not endorse, sponsor or guarantee these linked websites and are not responsible in any way for any advice, content, information, practices, products or services related to or made available through such linked websites. 
  6. Claims of Copyright Infringement: PayLessApartments.com® asks those posting or transmitting any content to or through the Services respect the intellectual property rights of others. If you believe that your work has been copied and/or infringed on any of our Services, you may notify us according to the notice requirements of the Digital Millennium Copyright Act, 17 U.S.C. § 512(c)(2) (“DMCA”) by sending the following information to PayLessApartments.com® ’s DMCA Registered Agent either by mail to PayLessApartments.com® Attn: General Counsel, 6801 Lake Worth Road, Suite 315 Greenacres, FL 33409; by email to copyright@www.paylessapartments.com; or by calling (912) 729-5377.  A description of the copyrighted work that you claim has been infringed; Identification of the material You claim is infringing, including a description of where such material is located;  Your address, telephone number, and e-mail address; A signed statement that the information in your notice is accurate, that you have a good faith belief that the identified use is not authorized by the copyright owner, its agent, or the law, and under penalty of perjury, that that you are the copyright owner or are authorized to act on the copyright owner’s behalf.

Intellectual Property: You acknowledge that the Services are owned and operated by PayLessApartments.com®.  The user interfaces, design, information, data, code, products, software, graphics, and all other elements including certain trademarks, service marks, and other indicia of source (together “IP”) are protected by intellectual property, international treaties, and other laws. You agree not to copy, use, infringe or dilute the intellectual property. The “PayLessApartments.com®” name and logo are trademarks of PayLessApartments.com®. Other product and company names herein may be trademarks of their respective owners.  Any unauthorized access to, reproduction, redistribution, publication, display or other use of the Software is expressly prohibited by law and may result in severe civil and/or criminal penalties. Violators will be prosecuted to the maximum extent possible.
  8. Linking:   If you operate a website and wish to link to the Services, You may link to the Service’s home page, www.Paylessapts.com. You may link to other pages found on the Services only if there is no manipulation to the canonical URL. Paylessapts.com reserves the right to disavow, reject or terminate any links to the Services. 
  9. User Materials: By submitting ads, photos, videos, descriptions, data, text, listings, or other information (“User Materials”) to the Services, you hereby grant to PayLessApartments.com® a royalty-free, perpetual, irrevocable, nonexclusive, fully transferable, sub-license, worldwide right and license to copy, modify, display, distribute, perform, create derivative works from, store, and otherwise use and exploit all such User Materials in any form, media, software or technology of any kind now existing or developed in the future. You further grant to PayLessApartments.com® a royalty-free right and license to use your name, image and likeness in connection with the reproduction or distribution of the User Materials. The Services may offer opportunities for eligible users to submit User Materials expressing opinions and sharing ideas. PayLessApartments.com® does not endorse the accuracy or reliability of any such opinions. By posting or submitting opinions, you agree to abide by these Terms of Use. You may not use the Services to engage in any prohibited activities.

PayLessApartments.com®’s Limitation of Liability and Rights:  PayLessApartments.com® does not monitor all of the User Materials posted or transmitted by you and other third-party information providers. However, PayLessApartments.com® reserves the right, in its sole discretion, to monitor, refuse to publish, remove, delete, move or edit any User Materials without notice, at any time for any reason. By using the Services, you expressly agree that PayLessApartments.com® will not be liable for any claims, actions or judgments arising out of or related to any User Materials and may monitor, refuse to publish, remove, delete, move or edit any User Materials without notice for any reason, without liability and without providing a refund. You further expressly agree that you are solely responsible for any and all User Materials you submit to the Services.

Unsolicited User Materials:  PayLessApartments.com® does not accept unsolicited content or ideas for use or publication in its programming or in other digital, electronic or print media except in connection with forums, chat rooms, bulletin boards or other mediums on the Services. PayLessApartments.com® and its affiliates shall not be responsible for the similarity of any of its content or programming in any media to User Materials or ideas transmitted to the Services.

Representations/Indemnity:  You hereby represent, warrant and agree that you have all necessary authority, rights and permissions to submit the User Materials to the Services, the User Materials does not and will not infringe or misappropriate any copyright, trademark, trade secret, patent or any other intellectual property or other right of any third party, including any rights of privacy or publicity, the User Materials and your use of the Services does not and will not violate any applicable federal, state, or local law or regulation including, but not limited to, any fair housing laws or regulations or applicable real estate licensure or brokerage regulations, or cause injury to any person, the User Materials is complete, truthful, accurate and not misleading to any other user of the Services. You acknowledge that these representations concern facts that are material and that PayLessApartments.com® will justifiably rely upon your material representations. You agree to release, defend, indemnify and hold PayLessApartments.com® and their respective officers, directors, employees, agents and contractors harmless from and against any and all claims, costs, demands or expenses, including attorneys’ fees, arising from any distribution, publication, refusal to publish, removal, deletion, movement, editing or other use of the User Materials you provide, your use of the Services or any reliance thereon, your breach of these Terms of Use or any actual, prospective or terminated lease or other transaction between you and a third party. 
  13. Prohibited Activities:  Prohibited activities by Landlords, Renters or others using the Services include but are not limited to submission of User Materials that is patently offensive to the online community, such as content that reflects or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;  engagement in activity or submission in User Materials that could be harmful to minors; engagement in activity or submission of User Materials that harasses or advocates harassment of another person; engagement in activity that involves the transmission of “junk mail” or unsolicited mass mailing or “spam” to others;  engagement in activity, submission of User Materials, or promotion of information, that is fraudulent, false, misleading, inaccurate and/or constitutes a misrepresentation, or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;  submission of User Materials that contains restricted or password-only access pages, or hidden pages or images;  submission of User Materials that displays pornographic or sexually explicit material of any kind;  submission of User Materials that provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses; engagement in activities or submission of User Materials that solicits passwords or personally identifiable information from others for unlawful purposes;  engagement in commercial activities and/or sales without our prior written consent, such as contests, sweepstakes, barter, advertising and pyramid schemes; use of the Service’s lead forms and/or toll-free numbers to advertise or promote products and services to PayLessApartments.com® advertisers or to solicit PayLessApartments.com® advertisers in any manner; use of any robot, spider or other automatic device, or a manual process, to access, monitor or copy web pages or other material contained in the Services or for any other unauthorized purpose; use of any device, software or routine to interfere or attempt to interfere with the proper working of the Services; reverse engineering, disassembly or other attempt to obtain the source code for the Software; or any action that imposes an unreasonable or disproportionately large load on PayLessApartments.com®’s hardware and software infrastructure.
  14. Fair Housing Laws Compliance:  All User Materials is subject to federal fair housing laws, which make it illegal to indicate in any advertisement any preference, limitation, or discrimination because of race, color, religion, sex, physical or mental disability, and/or familial status. Individual state jurisdictions may also prohibit any preferences based on sexual orientation, marital status, ancestry, source of income, or other criteria. Any question about the fair housing laws and housing discrimination in general, should be directed to your local fair housing agency or the U.S. Department of Housing and Urban Development. For a list of all fair housing groups, go to the Housing Rights Center’s website at www.hud.gov. 
  15. Listings: By using the listing services to advertise on the Services, you represent and warrant that the property for rent is an apartment, condo, townhome, or single family home and not a sublease for a unit in a multi-family apartment community, you own or have the right to advertise the property you are listing, you have the right to lease the advertised property, you are willing to lease the advertised property at the price and on any other terms specified in your listing, you will not advertise more than one property in a single listing on the listing service, (the determination of whether a property is one property or more than one property will be based upon such factors as the existence of a single land parcel ID number, contiguity of distinct land parcels, common amenities shared by more than one land parcel and other factors that will be used at the sole and absolute discretion of PayLessApartments.com®) either by including descriptions of multiple units in one listing or by subsequently updating the listing information to advertise different properties or units, or use any other artifice or device to accomplish this prohibited purpose. Upon leasing or otherwise taking your property off the market, you will delete the listing within 48 hours for that property, you will not use the listing Service or the Site for any fraudulent, false, misleading or deceptive activity, all User Material that you provide to PayLessApartments.com® and everything in your listing, including without limitation, any photos or text description, is truthful, accurate and complete and comply with all local, state and federal laws and regulations, including without limitation, fair housing laws, photos you upload to the listing service will only show the property listed for rent and shall not include, objects or features not part of the apartment or apartment community. If you are submitting a free listing you further represent and warrant, in addition to the above representations and warranties, that the property you are advertising is one of no more than less 5 separate living units.  You are not eligible to use the free listing services if the unit you are advertising is part of a complex or other development of more than 5 units under a single or related ownership.  By submitting a listing via the listing service, you grant to PayLessApartments.com®, a perpetual and irrevocable license to copy, modify, display, distribute, create derivative works from, or otherwise use and exploit the Content that you submit. The permission you grant PayLessApartments.com® includes express permission to syndicate the listing and User Material to affiliated or partner sites PayLessApartments.com® reserves the right, in its sole discretion, to remove any listing or User Material from the listing service, without notice and without liability, that does not meet the requirements of the Terms of Use or PayLessApartments.com® determines, in its sole and absolute discretion, the User Material is inappropriate for any legal, business, technical or other reason.  You may not list your property on the Services at a rental price that is above what you are currently listing the property or otherwise designed to recoup the discount you are offering to a Renter. Additionally, you may not list the same property at a lower monthly rent on the Services.   PayLessApartments.com® reserves the right to remove any listings found to be inconsistent with our listing requirements or that conflicts with the same property’s pricing on competing rental listing service.
  16. Our Legal Rights: You acknowledge that any breach of these binding Terms of Use, or any unauthorized use of the Services, is a material breach of the agreement between you and PayLessApartments.com® and will cause irreparable harm and injury to PayLessApartments.com® , for which there is no adequate remedy at law. Therefore, in addition to all other remedies available at law or in equity, you agree that in the event of such breach PayLessApartments.com® shall be entitled to injunctive or other equitable relief, whether or not liquidated damages are available without the requirement that PayLessApartments.com® post a bond. 
  17. Warranty Disclaimer:  YOU EXPRESSLY AGREE THAT USE OF THE SERVICES AND RELIANCE ON ITS CONTENT IS AT YOUR OWN RISK.  PAYLESSAPARTMENTS.COM®, MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE SERVICES, THE SOFTWARE, THE CONTENT, THE LISTING SERVICE OR THE RESULTS THAT MAY BE OBTAINED FROM USE OF ANY OF THE FOREGOING. THE SERVICES, THE SOFTWARE, THE CONTENT, AND THE LISTING SERVICE ARE PROVIDED ON AN “AS IS, AS AVAILABLE” BASIS, AND PAYLESSAPARTMENTS.COM®, SPECIFICALLY DISCLAIM ANY AND ALL EXPRESS OR IMPLIED WARRANTIES INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, AND WARRANTIES OF MERCHANTABILITY. PayLessApartments.com® makes no express or implied representations or warranties, to any Renter as to the existence, ownership or condition of the property or its availability, rent, lease terms, security deposit, application fees or as to the accuracy or completeness of any information about the property appearing on the Services.  All properties are subject to availability and prior lease. Any issues a Renter may have regarding a property must be addressed with the Landlord. PayLessApartments.com® makes no representations or warranties that a Renter will lease a Landlord’s property, that a Landlord will obtain an acceptable rent for the property, receive only legitimate inquires from qualified Renters or receive any inquiries for the Landlord’s property.
  18. Limitation of Liability:  PAYLESSAPARTMENTS.COM® SHALL IN NO EVENT BE LIABLE FOR ANY DAMAGES OR LOSSES INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES, RESULTING FROM OR CAUSED BY THE SERVICES, THE SOFTWARE, CONTENT, THE LISTING SERVICE, THESE TERMS OF USE OR OTHERWISE INCLUDING, WITHOUT LIMITATION, DAMAGES RESULTING FROM NEGLIGENCE. IN NO EVENT WILL THE AGGREGATE MAXIMUM LIABILITY OF PAYLESSAPARTMENTS.COM®, ITS OWNERS, EMPLOYEES, AGENTS, CONTRACTORS AND THIRD-PARTY LICENSORS OF ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICES EXCEED THE TOTAL AMOUNT OF FEES ACTUALLY PAID TO PAYLESSAPARTMENTS.COM® . THE NEGATION OF DAMAGES SET FORTH ABOVE IS A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN PAYLESSAPARTMENTS.COM® AND YOU. THE SERVICES WOULD NOT BE PROVIDED TO YOU WITHOUT SUCH LIMITATIONS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM PAYLESSAPARTMENTS.COM® CREATES ANY WARRANTY, REPRESENTATION AND/OR GUARANTEE NOT EXPRESSLY STATED IN THIS AGREEMENT.
  19. Termination of Service:  You agree that in PayLessApartments.com®’s sole discretion, and without prior notice, may terminate or suspend your access to the Services, and PayLessApartments.com® may exercise any other remedy available and remove any User Materials, if it believes that your use of the Services and any User Materials you provide violates the Terms of Use, the rights of PayLessApartments.com®, or another user, or any law or regulation, or are otherwise objectionable or inappropriate or constitute fraudulent or unlawful activity of any nature. You agree that monetary damages may not provide a sufficient remedy to PayLessApartments.com® for violations of these Terms of Use, and you consent to injunctive or other equitable relief for such violations without the requirement that PayLessApartments.com® post a bond. PayLessApartments.com® is not required to provide any refund to you if your use is terminated as a result of PayLessApartments.com®’s determination, in its sole discretion, that you have violated these Terms of Use.
  20. Waiver:  You agree that any individual or entity that violates any provisions of these Terms of Use is precluded from enforcing, agrees not to enforce, and covenants not to sue to enforce, any similar or related provision in any contract, including terms and conditions, terms of use and terms of service, asserted by such individual, entity or any affiliate thereof, as binding upon PayLessApartments.com®.
  21. Miscellaneous:  These Terms of Use may be changed at any time and you will be notified of any such changes by an updated posting of the new Terms of Use on this page of the Services. Your continued use of the Services after the posting of any amended Terms of Use shall constitute your agreement to be bound by any such changes. PayLessApartments.com® may modify, suspend, discontinue or restrict the use of any portion of the Services without notice or liability. These Terms of Use will be governed by and construed in accordance with the laws of the State of Florida and venue shall lie in Palm Beach County without regard to its conflicts of law provisions.  You hereby consent to personal jurisdiction in Palm Beach County, Florida and waive any objection based on forum non conveniens. As a condition of using the Services, you agree that all causes of action arising out of or connected with the Services shall be resolved individually, without resort to any form of class action. If for any reason a court of competent jurisdiction finds any provision of these Terms of Use, or portion thereof, to be unenforceable, that provision of these Terms of Use will be enforced to the maximum extent permissible so as to affect the intent of the parties, and the remainder of these Terms of Use will continue in full force and effect. Failure by PayLessApartments.com® to enforce any provision of this Terms of Use will not be deemed a waiver of future enforcement of that or any other provision of these Terms of Use. These Terms of Use and any other terms and conditions or policies applying to your use of the Services, constitute the entire agreement between the parties regarding the subject matter hereof. Nothing contained herein shall be construed as creating a partnership, joint venture or agency relationship or granting a franchise between the parties. Notwithstanding anything to the contrary herein, if you and PayLessApartments.com® have entered into a separate written PayLessApartments.com® advertising contract, the terms and conditions of such contract shall control with respect to any term that is inconsistent with these Terms of Use.

We may also use personally identifiable information to communicate with you regarding the Services such as sending emails or a phone call you to confirm an apartment availability inquiry or to notify you that you have received a lead regarding an apartment you have advertised or to request that you participate in a survey. Other instances of our use of personally identifiable information are sending promotional materials, electronic newsletters, or other content via email, targeted advertising, or otherwise, unless you have indicated that you do not wish to receive such materials, to improve your user experience, to manage our relationships with our customers, and other third parties to which the Services may disclose personally identifiable information pursuant to this Statement such as providing reporting to customers, providing customer support, and resolving disputes. We may also use personally identifiable information for Services administration, analysis, research, development, optimization and other internal purposes, including, without limitation, to compile Provided Data.

Provided Data: Provided Data is used by the Services for administrative, analytical, research, optimization and other purposes.  IP Addresses are also used for systems administration and troubleshooting purposes. The Services will discontinue sending promotional materials and electronic newsletters via email, if you request, by following the unsubscribe instructions in each promotional email from the Services or by a request sent to unsubscribe@www.paylessapartments.com. By utilizing the Services, you irrevocably agree that the Services may send to you communications of a transactional or relationship nature, including, but not limited to, communications regarding fraudulent or illegal activity, account status, changes to this Statement or the Service’s Terms of Use, as well as communications to confirm, fulfill and follow up on your registration, service or a request submitted through the Services.  The Services reserve the right to share Provided Data with any third party for any reason.
  6. Information Sharing:  The Services may share personally identifiable information that you provide with third parties including with Renters and Landlords provided such partner’s disclosure and use of the information is consistent with this Statement.
  7. Requests:  The Services maintain relationships with third party providers for some of the products and services offered through the Services. If you request information or make other requests through the Services, you agree that the Services may share personally identifiable information as may be necessary to provide such information or to fulfill such request.  In some cases, the information that you provide through the Services may be collected directly by a third party or its designee. Personally identifiable information also may be shared with the specific third parties that can respond to your requests. The subsequent use or disclosure of any information collected by or provided to third parties is subject to their privacy policies and practices.
  8. Direct Marketing:  Except as provided herein, it is the Service’s policy not to disclose personally identifiable information of our customers to third parties specifically for the third parties’ direct marketing purposes. Although the Services will endeavor to notify all third-party direct marketers that the information provided to them is confidential, the subsequent use or disclosure of information is subject to those third parties’ privacy policies and practices.

Service Providers:  The Services works with third parties that provide various services on its behalf including but not limited to analytical, development, promotional, research, review moderation, and other services. The Services require that third party service providers maintain your personally identifiable information as confidential and use the information only to perform the tasks specified by the Services and not for their own promotional purposes.

The Services reserve the right to share any personally identifiable information you post on the Services and by posting personally identifiable information on the Services you consent to such sharing. The subsequent use and disclosure of such information is subject to the privacy policies and practices of those third parties.  The messages that the Services send to you to confirm, fulfill, or follow up on a request may include promotional material or other content from the Services or its partners and in such cases the Services are not sharing your personally identifiable information with those third parties.

Mobile Applications; Location Information:  Your location is obtained from the mobile device or the network, or directly from you, and is used to search for information you may need including local searches for rental properties. When we execute such searches we do not transfer identity or personally identifiable information to third parties, other than the Landlords(s). This information is not used to create a profile. Your location is stored in the app if you save your searches.  You may deleted this information by clearing your search history. Location coordinates are shared with our geocoding service provider(s) only to perform the task of providing maps and directions you may have requested. We collect non-personally identifiable information from your mobile device.
  12. Free Listing Terms of Use:  If you elect to use the Service’s free listing service to advertise a property, any information you choose to include in your listing may be made publicly available via the Services and other media in which the Services listings are published. If you include a phone number or an email address or other personally identifiable information to allow users to contact you regarding your listing, you may receive unsolicited phone calls and emails from third parties, even after your listing is no longer on the Services. Do not include any contact or other information in your listing other than required information that you do not want other parties to see or use. If you wish to access, verify the accuracy of, or change the personally identifiable information in your advertisement, you can use the interface available at https://www.paylessapartments.com. 
  13. Access to Personally Identifiable Information If your personal information changes, or if you no longer desire our service, you may correct, delete inaccuracies, or update your information by emailing us at support@www.paylessapartments.com.  We will retain your information as needed to provide our Services to you. If you wish to request that we no longer use your information to provide our Services, please contact us at support@www.paylessapartments.com.  We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. To request removal of your personal information from our discussion boards contact us at support@www.paylessapartments.com. If we are unable to remove your personal information, we will advise you we are unable to do so and why.

Global Privacy Considerations:  Personal information collected by us may be stored and processed, if applicable, in the United States or in any other country where PayLessApartments.com® or third-party service providers maintain facilities. When you provide personal information to us, you consent to the processing, if applicable, and transfer of your information within and without the United States. We follow applicable data protection laws when transferring personal information.
  15. European Privacy Rights:  We will process, if applicable, your personal information for our legitimate interests, or, when needed, with your explicit consent. If you have provided consent for the processing of your personal information, you have the right to withdraw consent at any time, which will not affect the lawfulness of the processing before your consent was withdrawn. You have the right to request access to and modification or erasure of your personal information, as well as the right to restrict processing, object to processing, and under specified circumstances, the right to data portability. You may submit a complaint with a data protection supervisory authority if you believe that we have not complied with the requirements of the General Data Protection Regulation with regard to your personal information. 
  16. Share a Listing:  The Services offer the ability to share certain pages or content of the Services with third parties. If you choose to use this feature, you will be asked for your email address and the recipient’s email address, and you may include a message. We do not use the email addresses stored for any purpose other than sending a one-time email to execute the sharing.
  17. Notification of Changes to this Statement:  Any changes to this Statement will be posted on the Services with a notification that it was changed effective on a specific date. If we change how we use your personally identifiable information, we will notify you here, by email, or by means of a notice on our home page. Your continued use of the Services after such notice constitutes acceptance of such changes.

Minors:  No information should be submitted to or posted at the Services by visitors younger than 18 years old.  The Services do not knowingly collect or use any personally identifiable information from persons younger than 18 years of age and the Services do not knowingly provide any personally identifiable information, regardless of its source, to any third party for any purpose whatsoever from persons younger than 18 years of age.
